Parental/Guardian Permission for Instruction and Prohibited Subject Matters

The instruction of sexual orientation or gender identity shall be prohibited in classroom instruction for grades K-12 or in a manner that is not age appropriate or developmentally appropriate for students in accordance with state standards.

No less than two (2) weeks prior to any instruction on Human Sexuality, as defined in Idaho Code 33-1609, the District is responsible for obtaining the written consent of the participating student’s parent/guardian and provide the parent/guardian with an opportunity to review the instructional materials. Prior to seeking out written consent, the instructor shall communicate with the building principal regarding the intended instruction to address whether such is permitted, consistent with the District’s approved curriculum and in accordance with state standards.

Teachers providing instruction on Human Sexuality may only utilize the educational materials that were made available for parental review. No additional or supplementary materials may be utilized.

For each instance of instruction under the definition of Human Sexuality as defined in Idaho Code 33-1609, it shall be the responsibility of the instructor to:

  1. Send out the parent/guardian permission forms to parents and guardians, as detailed herein, no less than two (2) full calendar weeks prior to intended instruction on Human Sexuality;
  2. Collect signed permission forms from student’s parents/guardians;
  3. Maintain signed permission forms for each instance of instruction on Human Sexuality in a secure location;
  4. Provide a copy/original signed parent/guardian permission form to the Director of Curriculum and Instruction.
  5. For students who have not received parental/guardian permission, make arrangements with the school’s administrator to exclude such student from instruction on Human Sexuality, including providing alternative lesson materials, a location for alternative instruction and arrangements for student supervision;
  6. Maintain a copy of the signed permission forms for a period of no less than year in a secure location; and.
  7. Fully participate in and cooperate with any investigation alleging a violation or failure to obtain knowing permission from a student’s parent or guardian prior to instruction in Human Sexuality.

Parental Complaints and Investigation

If a student receives instruction in the subject of Human Sexuality, as defined in Idaho Code 33-1609 , without the District having first obtained permission from the student’s parent or legal guardian, the parent or legal guardian is encouraged to first discuss the concern with the classroom teacher or the building principal of the school in which such instruction occurred. The goal of such communication will be an attempt to informally resolve the parent/guardian’s concern, and where appropriate, obtain retroactive written permission for the student’s participation.

If the complaint has not been informally resolved through the District’s receipt of retroactive written permission for the student’s participation, the parent/guardian shall file a written complaint to the Superintendent that the parent/guardian believes a violation of Policy 602. 40 has occurred. This complaint shall be in writing and shall include details as to the alleged violation (e.g. the date, classroom instructor and details as to the alleged violation and the requested rectification of the parent/guardian)

The Superintendent or designee shall meet with the parent/guardian and the student who attended the class(es) in question to obtain detail with regard to the alleged violation. Thereafter, in a timely manner, the Superintendent or designee shall commence an investigation into the complaint. This investigation may include, but will not necessarily be limited to:

  1. Review of instructional materials;
  2. Review of communications, if any, to the parent/guardian;
  3. Student interviews;
  4. Interview of the instructor;
  5. Interview of any other adult who may have been present for instruction and/or has knowledge of the subject instruction; and
  6. A review of the District’s policies, Idaho Code, and state educational standards on the subject instruction.

If the complaint is received within thirty (30) days of the end of the school year, efforts will be made to complete the investigation prior to the end of the school year. However, if such cannot be completed in the time frame prior to the end of the school year, the Superintendent or designee shall have the discretion to complete the investigation after the end of the school year or upon return for the next school year. Within thirty (30) days of receipt of the complaint, the Superintendent or designee shall have prepared a written report, having submitted such report to the Board of Trustees with recommendations for rectification or notifying the Board of the District’s receipt of written retroactive permission. Superintendent recommendations for rectification to the Board may include, but not be limited to:

  1. Change in District Policy and Administrative Regulation;
  2. Change in District permission forms and protocols for obtaining parental permission relating to Sex Education and/or Human Sexuality instruction;
  3. Change in District curriculum relating to Human Sexuality;
  4. Training for personnel relating to Human Sexuality education;
  5. Training for personnel relating to the content of District Policy, District Administrative Regulation, and/or Idaho Code regarding the instruction of Sex Education or Human Sexuality;
  6. Personnel Action; and/or
  7. Any combination of the above.

Depending on the nature of the subject personnel action, such may be independently taken by the District’s Superintendent or designee, consistent with District Policy and applicable provisions of Idaho Code. Any personnel action taken by the District associated with a violation of District Policy, District Administrative Regulation and/or Idaho Code relating to Human Sexuality shall remain confidential consistent with Idaho Code 74-106 and 74-104 in conjunction with Idaho Code 33-518, and shall not be disclosed to the complaining party or any other member of the public.

This form provides notice to the parent/legal guardian that the District intends to provide instruction on _(date(s)) with regard to the following topics that fall within the definition of Human Sexuality as stated in Idaho Code. The intended instruction will specifically address:









If you are in agreement with your student participating in such instruction, please sign this consent form, returning such to your student’s classroom teacher. If the District is not in receipt of written permission from you within one (1) week prior to the scheduled instruction your student will not be participating in this instruction and the school will make alternative educational arrangements for your student. If you submit your permission within one (1) week prior to the scheduled instruction, the school may permit your child to participate upon the school’s confirmation of your late consent.
